RESOLUTION NO. 2008-11
RELATIVE TO SUPPORTING THE GOVERNOR’S OPTION TO PROVIDE AN INTERIM JOHN F. KENNEDY HIGH SCHOOL CAMPUS

WHEREAS, the Organic Act of Guam provides that the Government of Guam shall provide an adequate education system; and
WHEREAS, 1 G.C.A., Section 715 provides that students attending the Guam Public School System should be educated in a healthy, safe and sanitary learning environment; and
WHEREAS, on June 9, 2008, the Attorney General’s Task Force closed the John F. Kennedy High School (JFKHS) campus for violations of health and safety codes; and
WHEREAS, a private architect and engineer firm has evaluated the existing JFKHS campus and determined that it would cost in excess of $19,000,000 to rebuild the school; and
WHEREAS, it has been determined it is in the best interest of the territory to rebuild a new facility on the same site (P.L. 29-114); and
WHEREAS, currently the students of John F. Kennedy High School and George Washington High School are receiving less instructional time each school day while attending a double session; and
WHEREAS, the Guam Education Policy Board Task Force and Superintendent have explored the option of double session using Chief Brodie Elementary School as an interim John F. Kennedy High School campus beginning next school year; and
WHEREAS, assessment by a private engineer firm has determined the conversion of Chief Brodie Elementary School to a high school will cost approximately 4.5 Million Dollars; and
WHEREAS, the Governor of Guam has offered Tiyan site as an alternative solution to the proposed Chief Brodie Elementary School option; and
WHEREAS, based on the tour of the Tiyan site, the site is feasible to be used as an interim John F. Kennedy High School campus; and
WHEREAS, it has been represented that the site can be prepared beginning of school year 2009-2010; and
WHEREAS, the Governor has requested that the Board convene an emergency session to establish the position of the Board regarding his proposed option of Tiyan.
NOW THEREFORE BE IT RESOLVED, that the Guam Education Policy Board hereby support the Governor’s proposal for the use of an interim campus for J.F.K High School; and
BE IT FURTHER RESOLVED, that the Governor and Superintendent takes whatever steps necessary to have a campus ready for occupancy with all collateral equipment by July 1, 2009 for School Year 2009 - 2010; and
BE IT FURTHER RESOLVED, that no funds from the Bond Funds established for repair of schools be used for this process; and
BE IT FURTHER RESOLVED, that no funds from the current Guam Public School System’s budget be used for repair or renovation for the interim campus for John F. Kennedy High School; and
BE IT FURTHER RESOLVED, that a copy of the same be transmitted to the Honorable Governor Felix P. Camacho, I Maga’ låhen Guahan, the Honorable Speaker Judith T. Won Pat, I Mina' Bente Nuebi Na Liheslaturan Guåhan and the Education Suruhanu.
